Fortify My Network provides remote cybersecurity, IT support, website security, website maintenance, and technology consulting services for small businesses and homeowners throughout the United States and Puerto Rico. Services include but are not limited to:

Our Services are offered on a monthly subscription basis. We offer the following plans:
Free Trial: New subscribers receive a 7-day risk-free trial. At the end of the free trial period, your account will be automatically charged according to your chosen subscription plan unless you cancel before the trial ends.
Annual subscriptions are available at a 15% discount. All plans are provided on a recurring basis and will automatically renew at the end of each billing period unless cancelled.
All payments are processed securely through Stripe. By subscribing to our Services, you authorize us to charge your payment method on a recurring basis at the applicable subscription rate.
If payment fails, we reserve the right to suspend or terminate your access to the Services until payment is received.
You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not offer prorated refunds for partial months.
We reserve the right to terminate or suspend your access to our Services immediately, without prior notice, if:

All content, materials, reports, documentation, and deliverables we create as part of our Services remain the intellectual property of Fortify My Network unless otherwise agreed in a signed Statement of Work (SOW).
Upon full payment, you receive a non-exclusive license to use deliverables created specifically for your business. You may not resell, reproduce, or distribute our proprietary materials without written consent.
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
CYBERSECURITY SERVICES REDUCE RISK BUT CANNOT GUARANTEE COMPLETE PROTECTION AGAINST ALL THREATS. WE ARE NOT RESPONSIBLE FOR BREACHES, ATTACKS, OR DATA LOSS THAT OCCUR DESPITE OUR REASONABLE EFFORTS.
TO THE FULLEST EXTENT PERMITTED BY LAW, FORTIFY MY NETWORK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Fortify My Network and its owner, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any third-party rights.
To expedite resolution and reduce costs, you and Fortify My Network agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration. Informal negotiations begin upon written notice from one party to the other.
If informal negotiations fail, any dispute, claim, or controversy arising out of or relating to these Terms or our Services shall be resolved by binding arbitration in Lynchburg City, Virginia, United States, under the rules of the American Arbitration Association (AAA).
Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court for matters involving intellectual property or unauthorized access to systems.
Any cause of action or claim arising out of or related to these Terms must be commenced within one (1) year after the cause of action accrues. Claims not brought within this period are permanently barred.
These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. If a dispute proceeds in court rather than arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Lynchburg City, Virginia.
We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last updated" date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.
