We use cloud-based practice management software. Are we already secure?
Your practice management vendor secures their platform — not the devices you use to access it, your email, your office network, or your file storage. You're also responsible for vetting that vendor's security practices and having appropriate agreements in place. Cloud software is one piece of a complete security posture, not a complete solution.
Do we need to notify clients if we have a breach?
Most states require breach notification to affected clients. Some state bar rules also require reporting to the bar. The specific requirements depend on your jurisdiction. What's universal is that a breach involving client confidential information triggers ethical obligations and potential disciplinary exposure — which is why prevention is far preferable to response.
